Expatriate formalities

Indonesia as one of the developing countries in the world has its own attractiveness for investors. The Increasing number of investments is also followed by an increase in the number of expatriates in Indonesia.

Expatriates are allowed to work in Indonesia after fulfilling a number of formalities as set either in immigration or labor regulations. We assist our Clients to obtain expatriate formalities and to comply with prevailing regulations in Indonesia. The following are some expatriate formalities required by the prevailing regulations in Indonesia:

Function of Permit

Foreign Manpower Utilization Plan (“RPTKA”)

An obligation to every employer who intends to employ foreign manpower to register its Foreign Manpower Utilization Plan to be approved by the Minister of Manpower;

Visit Visa

A type of visa for foreigners who are planning to visit Indonesia

Permit for Visit

Permit for Visit is granted to:

a. Foreigners who enter the territory of Indonesia with a visa for visitor; or

b. Newborn children in Indonesia and at the time of birth the father and/or mother are holders of permit for visit. The permit for visit is granted in accordance with the permit for stay of the father and/or mother.

c. Foreigners from countries liberated from the requirement to hold a Visa in accordance with the provisions of laws and regulations;

d. Foreigners serving as the crew of Transport equipment anchored in the territory of Indonesia in accordance with laws and regulations;

e. Foreigners who enter the territory of Indonesia in an emergency; and

f. Foreigners who enter the territory of Indonesia with a visa for visit upon arrival.

Limited Residence Permit (KITAS)

A type of visa for foreigners who are planning to stay in a longer duration for the purposes of working, investment, research, study, dependent, repatriation and retirement. To obtain this type of visa, the applicant may come to Indonesian Embassies or Consulates as Indonesia Representative Office overseas, or to Directorate General of Immigration in Jakarta

Permanent Residence Permit (KITAP)

A permit granted to foreigners to permanently stay in the Territory of Indonesia.

What documents are required to submit an application for RPTKA?

Pursuant to Article 7 of Presidential Regulation No. 20 of 2018, the following are the documents required to submit an application for RPTKA:

  1. Business permits issued by relevant agencies;
  2. Deed of Incorporation with its legalization from the Minister of Law and Human Rights and its amendment;
  3. Company organizational structure chart;
  4. Statement letter to appoint counterpart employees and carry out work education and training; and
  5. Statement letter to carry out work education and training for local employees in accordance with the qualification of the foreign employees.
Are the employers required to posses IMTA to use foreign employees in Indonesia?

After the issuance of Presidential Regulation No. 20 of 2018, IMTA requirements have been removed.

What documents are required to get a Limited Stay Permit (Izin Tinggal Terbatas, “ITAS”)?

The documents required to obtain ITAS are (1) guarantee letter issued by a guarantor; (2) valid passport; (3) certificate of domicile; and (4) recommendation letter issued by relevant government agencies.
